The Employer's Guide to AI Workplace Policies

How to develop a comprehensive AI use policy that governs employee use of generative AI tools while protecting company data and compliance.

The AI Policy Imperative

Generative AI tools like ChatGPT, Google Gemini, Microsoft Copilot, and numerous specialized applications have entered the workplace whether employers planned for them or not. Employees are using these tools to draft communications, analyze data, create presentations, write code, and much more. Without a clear policy, employers face risks related to data security, intellectual property, accuracy, and regulatory compliance.

An AI use policy establishes the rules of the road. It should enable productive use of AI while protecting the organization from foreseeable risks.

Key Components of an AI Policy

Scope and Definitions

Define what the policy covers. "AI tools" should be defined broadly to include generative AI chatbots, AI-powered features embedded in existing software, AI coding assistants, image generators, and any tool that uses machine learning to generate content or recommendations.

Specify who the policy applies to: all employees, contractors, interns, and anyone using company systems or handling company data.

Approved Tools

Maintain a list of AI tools that have been reviewed and approved for use in your organization. The review should assess data privacy practices, security controls, intellectual property terms, and compliance with applicable regulations. Tools that have not been reviewed should be prohibited until assessed.

Some organizations take a tiered approach: fully approved tools with minimal restrictions, conditionally approved tools with specific use limitations, and prohibited tools.

Data Protection Rules

This is the most critical section. Establish clear rules about what data can and cannot be entered into AI tools:

  • Never enter confidential business information, trade secrets, customer data, employee personal information, financial data, legal matters, or any information subject to regulatory protection (HIPAA, FERPA, etc.)
  • Be cautious with internal communications, draft documents, and proprietary processes
  • Generally acceptable to use with publicly available information and original prompts that do not contain sensitive data

Many AI tools use input data for training purposes. Even tools that claim not to may change their terms of service. Treat any data entered into an external AI tool as potentially public.

Accuracy and Human Review

AI-generated content can be inaccurate, biased, or fabricated. Require that all AI-generated work product be reviewed by a qualified human before use. The employee who submits AI-assisted work is responsible for its accuracy, just as they would be responsible for any other work product.

This is particularly important in regulated contexts where inaccurate information can create legal liability, such as financial disclosures, legal filings, medical information, and compliance documentation.

Intellectual Property

Address IP considerations in your policy:

  • Work created with AI assistance is subject to the same IP assignment provisions as any other work product
  • Employees should not input the company's proprietary code, formulas, or creative works into AI tools
  • AI-generated content may not be eligible for copyright protection, which affects how it should be used

Disclosure Requirements

Determine when the use of AI must be disclosed. Many organizations require disclosure when AI is used to generate client-facing communications, published content, regulatory submissions, or code that will be deployed in production. Internal use for drafting and brainstorming may not require disclosure, depending on context.

Prohibited Uses

Explicitly prohibit uses that create unacceptable risk:

  • Using AI to make employment decisions (hiring, firing, performance evaluation) without human oversight and legal review
  • Generating communications that impersonate real individuals
  • Using AI to circumvent compliance controls or security measures
  • Relying on AI for legal, medical, or financial advice without professional review

Implementation

1. Involve stakeholders. Develop the policy with input from IT, legal, HR, compliance, and business units. A policy written solely by one function will miss important perspectives.

2. Train employees. Roll out the policy with training that includes practical examples of permitted and prohibited uses. Abstract rules are less effective than concrete scenarios.

3. Update regularly. AI technology and the legal landscape around it are evolving rapidly. Review your policy at least quarterly and update it as new tools emerge, new risks are identified, or new regulations are enacted.

4. Enforce consistently. A policy that exists on paper but is not enforced provides no protection. Monitor compliance and address violations through your standard disciplinary process.

AI tools offer genuine productivity benefits. A well-crafted policy lets your organization capture those benefits while managing the risks responsibly.
