The Regulatory Environment Has Matured

Two years ago, AI workplace regulation was mostly theoretical. By 2025, it is operational. Multiple states have enacted laws governing AI in employment, the EEOC has issued enforcement guidance, and employers face real compliance obligations for their use of automated decision-making tools. This article provides an updated view of the regulatory landscape and what employers should be doing now.

Federal Developments

EEOC Enforcement

The EEOC has continued to make AI a strategic enforcement priority. The commission has pursued investigations and enforcement actions focused on AI tools that produce disparate impact in hiring and promotion. The legal theory is straightforward: Title VII prohibits employment practices with discriminatory effects regardless of whether the discrimination was intentional, and this applies equally to decisions made by algorithms.

The EEOC's technical assistance documents provide specific guidance on how AI tools can violate Title VII and the ADA, including tools that screen out applicants with disabilities by relying on assessments that measure characteristics unrelated to job performance.

Executive Actions

Federal executive orders have established frameworks for AI safety and accountability, including provisions affecting federal procurement and encouraging private-sector adoption of responsible AI practices. While not directly creating private employer mandates, these actions signal the direction of federal policy and may influence future legislation.

State Laws in Effect

Colorado AI Act

Colorado's law requires deployers of high-risk AI systems, including employment tools, to implement risk management policies and conduct impact assessments. Employers must disclose to individuals when AI is used in consequential decisions and provide information about how to contest adverse decisions. The law includes specific requirements for documentation, notification, and remediation.

Illinois

Illinois requires consent and disclosure for AI analysis of video interviews and has expanded protections to cover other forms of AI-driven employment assessment.

New York City

Local Law 144 continues to require annual independent bias audits and candidate notification for automated employment decision tools. Enforcement activity has increased, with fines being assessed against non-compliant employers.

Other States

Maryland prohibits the use of facial recognition technology in job interviews without consent. Several other states have introduced comprehensive AI employment bills, and the legislative pipeline suggests additional state laws will take effect in 2025 and 2026.

What Employers Should Do Now

Build an AI Governance Framework

If you have not already, establish a cross-functional AI governance team that includes HR, legal, IT, and business leadership. This team should:

  • Maintain an inventory of all AI tools used in employment decisions
  • Evaluate new tools before adoption
  • Monitor compliance with applicable laws
  • Review and update policies regularly

Conduct Impact Assessments

For every AI tool used in employment decisions, conduct a documented impact assessment that evaluates potential discriminatory effects, data privacy implications, accuracy and reliability, and the availability of human review mechanisms. Where laws require formal impact assessments (as in Colorado), follow the prescribed methodology.

Test for Bias

Conduct regular adverse impact analyses of your AI tools' outcomes. Break down selection, scoring, and recommendation rates by race, sex, age, disability status, and other protected categories. Address any disparities identified through the testing.

Ensure Human Oversight

No AI system should make final employment decisions without meaningful human review. "Meaningful" means a qualified person reviews the AI's recommendation, has access to sufficient information to override it, and actually does override it when warranted. Rubber-stamping AI outputs does not constitute human oversight.

Maintain Transparency

Provide clear notice to candidates and employees when AI tools are used in employment decisions. Describe what the tool does, what data it uses, and how individuals can request additional information or contest adverse decisions.

Prepare for New Obligations

Monitor legislative developments in every state where you hire or employ workers. Build flexibility into your compliance framework so that new requirements can be integrated without starting from scratch.

Vendor Accountability

Your AI vendors bear significant responsibility for the tools they sell, but the legal liability for employment decisions remains with the employer. Hold your vendors accountable by requiring contractual commitments to bias testing, data privacy, and compliance cooperation. Conduct independent verification rather than relying solely on vendor representations.

The employers who will navigate this landscape most successfully are those who treat AI governance as an ongoing discipline rather than a one-time project. The tools are powerful, the risks are real, and the regulatory requirements will only increase.
